It’s important you have your gas appliances checked regularly by a gas engineer on the Gas Safe Register to ensure your appliances are working safely and efficiently. Following completion of checking your gas appliances the gas engineer may provide you with a certificate. This certificate is known as a Gas Safety Record. In this article, we explain what a gas safety certificate is and who needs one.

So, what is a Gas Safety Certificate?

A gas safety certificate is the document that may be issued to you by a gas engineer after they have completed gas work at your property. The document you receive from the gas engineer will depend on the type of work they’ve undertaken whether it is a service or a safety check.

Who needs a Gas Safety Certificate?

All gas engineers are required by law to be on the Gas Safe Register so, they are legally permitted to carry out gas work. However, it is not a legal requirement for them to provide a Gas Safety Certificate after they complete work on your appliances, unless you are a landlord. Below we explain who needs a gas safety certificate…

Homeowners are not legally required to have a gas safety certificate. However, they should still get their gas appliances checked and serviced every year by a Gas Safe registered engineer. You can ask your engineer to give you any documents which shows you’ve had a gas safety check, or any other work done.

Landlords are required by law to have a gas safety check carried out every year at their rented property. The check must be completed on all gas appliances and installations owned by the landlord in each of their properties. This is a requirement of the Gas Safety (Installation and Use) Regulations 1998. For example, if a gas appliance is owned by the tenant, then the landlord is not legally responsible for having it checked. Following completion of the gas safety check the engineer will provide the landlord with a Gas Safety Record (previously known as Gas Safety Certificate or a CP12).

The Gas Safety Record given to the landlord will show:

  • A description of each gas appliance tested
  • The results of the safety checked completed on each gas appliance
  • Any safety issues identified during the checks
  • Any action or work needed to ensure safety
  • Details of the engineer who completed the checks, their signature and the date of the check
  • Details of the landlord and the property

A landlord must provide their tenant with a copy of the Gas Safety Record for the property.

Gas Safety Services for Landlords

As a landlord you have a legal duty of care for tenant(s) living in your rented property. The Gas Safety (Installation and Use) Regulations 1998 outlines your responsibilities as a landlord to make sure all gas appliances, fittings, chimney and flues are safe and working correctly. If you’re renting out a property with gas appliances installed, you’ve got 3 main legal responsibilities including:

Gas Safety Checks – To ensure the safety of your tenants whilst living in your rented property, all gas appliances and flues must undergo an annual Gas Safety Check carried out by a Gas Safe registered engineer. Following completion of this check, you will be given a Gas Safety Certificate or a Landlord Gas Safety Record with all the details of the checks that were carried out. This can also be referred to as a CP12 certificate. The Gas Safety Check can be carried out any time from 10-12 months after the last check, without impacting the original date.

Gas Safety Record – After the gas safety check and the receipt of your Landlord Gas Safety Record, you’ll need to provide a record of this check to your tenant(s). By law, you should give your current tenant(s) a copy of your Landlord Gas Safety Record within 28 days of the gas safety check. For new tenant(s) the record will need to be provided at the start of their tenancy.

Maintenance – As a landlord you need to make sure that all gas pipework, appliances and chimneys and flues are kept in safe condition. It’s important to check the manufacturer’s guidelines on your gas appliances to find out how often a service is recommended.
